Daygo — Terms of Service

1. Acceptance
By using Daygo you agree to these terms. If you don't, don't use Daygo.
2. What Daygo is (and isn't)
Daygo is a wellbeing app that helps you reflect on how you feel, what you've done, and what's likely to help. It uses AI (Anthropic's Claude) to generate the explanations.
Daygo is not a medical device. It does not diagnose, treat, cure, or prevent any disease. Anything Daygo says about your health is for general informational purposes. Always consult a licensed clinician for any medical decision.
3. Your account
- You must be 13 or older (16 in the EU).
- You're responsible for what happens under your account.
- You agree not to share an account with someone else.
4. Subscriptions and billing
- Daygo offers a free tier and a paid subscription. Pricing is shown in-app at purchase.
- All subscriptions are billed by Apple via your App Store account.
- Subscriptions auto-renew unless cancelled at least 24 hours before the period ends.
- Refunds are handled by Apple under App Store policies; we cannot issue refunds directly.
5. Acceptable use
You agree not to:
- Reverse-engineer the app, its API, or any prompt content.
- Use the app to harm yourself or others (Daygo is not a crisis tool — call your local emergency number).
- Send content that is illegal, harassing, infringing, or that would expose another person's private health data without their consent.
- Bypass rate limits, scrape data, or run automated clients.
6. Your content
You own the data you put into Daygo. By using Daygo, you grant us a non-exclusive license to process that data so we can provide the service (e.g. send the relevant slice to Anthropic for AI coaching).
We do not sell or use your content for advertising, and we do not allow Anthropic to train models on it.
7. AI outputs
AI outputs are best-effort and may be wrong. They are not advice. We make no guarantees about accuracy, completeness, or fitness for any purpose.
8. Service availability
Daygo is provided "as is" and "as available." We may change, pause, or discontinue features without notice. We don't promise uptime.
9. Limitation of liability
To the maximum extent allowed by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or USD 100, whichever is greater.
If your jurisdiction doesn't allow these limits, they apply only to the extent permitted.
10. Termination
You can stop using Daygo at any time and delete your account in Settings. We can suspend or terminate your access if you violate these terms.
11. Governing law
These terms are governed by the laws of [Lithuania / your operating jurisdiction]. Disputes go to the courts of that jurisdiction unless you have mandatory rights to a local forum.
12. Changes
We may update these terms. If we make material changes we'll notify you in-app. Continued use means you accept the new version.
